Your input is a crucial part of the planning process. Each of my clients has a different financial and family situation, which is why I will review your asset base and family structure (i.e., first marriage, minor children, blended family, single, etc.), before suggesting any services.

You will be happy and satisfied with my ability to prepare a variety of trusts such as a revocable living trust, irrevocable life insurance trust, family dynasty trust, charitable trust, and other trust agreements suited to your specific needs. You and your loved ones will also receive assistance with settling a trust or probate an estate, handling the estate taxes, and inheritance taxes and other debts that might need to be settled before the trust assets or probate assets are distributed.

"I am a member of the Academy of Special Needs Planners" - John A. D'Onofrio, Esq.

As a member of the Academy of Special Needs Planners I have assisted hundreds of families establish Special Needs Trusts as well as get Guardianship appointment over their Special Needs Child.

The most frequent question that I receive as an estate planning attorney is, "What will happen to my special needs child if something happens to me?" Parents specifically want answers to the following:

  • Where will my special needs child live?
  • Who will take care of my child on a daily basis?
  • How will my special needs child get to doctors' appointments, school or to other activities?
  • Who will provide for my special child's housing, clothing, food and medical needs?

Thorough estate planning can help you avoid the probate process, but in some cases that simply isn't an option. I have dealt with many courtroom probate processes, always aiming to minimize the costs associated with probate as well as the time my clients' executor may have to spend in court.

If a loved one has recently died and you are named as the executor or if your loved one died without a last will and testament, you will need assistance with the preparation of the petition, which will be filed on behalf of the estate with the appropriate orphans' court. Once you are sworn in as either the executor or the administrator of the estate, I will guide you through the probate process. As your lawyer, it is my goal to give you peace of mind by handling your legal matters knowledgeably and efficiently.
