When my wife passed away I became concerned about what would happen to my disabled daughter in the event of my death. I wanted to be sure that what little I have in the way of funds would go to her with minimal impact on any government funds (i.e. Social Security, Medicare) that might become available to her. I was advised to have a "Special Needs Trust" set up for her. I contacted a couple of local attorneys who provided unsatisfactory responses. An acquaintance whose son has the same disability as my daughter provided me with information that led to my contacting Attorney John D'Onofrio. My daughter and I met with John on two occasions and provided him with our necessary personal information. John then promptly provided us with the following legal documents: a Special Needs Trust and a will for my daughter, and for me — a will, a living will and a power of attorney document. In addition, John gave us instructions on how to provide the necessary documents to health care providers and to our bank, where a special account had to be set up for the Special Needs Trust. John is a very congenial person who treated my daughter with respect and courtesy during our two meetings. His office is accessible and attractive and the staff was very kind and helpful. I met John D'Onofrio in 1991 when I was living in Monroeville, Pennsylvania. Even though I now live in Texas, he has been providing estate planning and other legal services to my whole family including my parents and five sisters ever since. Like many families, our parents provided us every opportunity to succeed, but they didn't plan for their retirement nor did they ever stop to consider their medical needs or desires as they aged. They were living the best they could while raising six kids and they procrastinated on the planning process until the reality of retirement overcame them. Unfortunately, the simple life of retirement is often complicated by declining health and income. Our self-education process was time consuming as we swam in a sea of 'alphabet soup.' In reality, we didn't want to know "everything" about estate planning and government regulations; but instead, we really needed to know our options as it applied to our family's situation. Sensing our need to be more informed, John referred resources to us so we could better understand the myriad options of Medicare and other Federal and state assistance programs. Just discussing the planning process with five other siblings and your parents is a recipe for conflict fueled by emotions and clouded by partial data regarding the process. John was able to provide unbiased advice at a time of high emotion amongst the very strong personalities within our family. He patiently explained the various options and complexities of the estate planning process, long-term care, and medical directives as they related to our parent's current health, their wishes, their estate and the law. He helped us to address specific issues one at a time instead of trying to address everything at once which can become confusing. He ultimately created the estate planning documents needed for my parents which we all agreed upon. We would not have been able to navigate the complexity of estate planning and future medical care for ourselves and our parents by using cheap Will creation software or navigating for answers via Google. Our parents are too important and their lives are too complex to fit into a Word template, plus the various laws are ever changing. As a child, ignorance may be bliss, but as an adult we are called to educate ourselves, seek wise counsel, create a plan and then ultimately, we must execute the plan. My only regret is that we should've begun the process decades before my parents retired. This process with my parents motivated my wife and I to complete our estate planning process even though we have over 30 years to retirement. We don't want our two sons to endure the process like I did with my sisters. If you realize the importance of planning, then I highly recommend John D'Onofrio. His wise counsel has been invaluable to our family.
