probate matters. As such, I am here to provide the quality legal representation you need.

Established by Jackie Kennedy, this is a national recognition system honoring community and public service. I have the expertise and education to handle almost any estate planning complication, working hard to find effective solutions. My focus is to bring your plan together with your future objectives and goals in mind, ensuring you are pleased with your quality estate plan as prepared by D'Onofrio Law Office, P.C.
A Heart for Special Needs
While I focus on helping a variety of clients create their estate plans, I am especially passionate about special needs planning. Throughout my legal career, it has been my goal to raise awareness to the specific legal process available to protect special needs individuals. I aim to provide every family who has a special needs member with a professional special needs plan which will secure the future needs of the disabled family member. As a member of the Academy of Special Needs Planners, I am continually improving my legal expertise and knowledge in this field.
When your child or loved one has special needs, it's important to create a plan for their future protection. Most parents wonder what would happen to their special needs child if they could no longer care for them. With special needs planning, you can use a variety of legal methods, most specifically a special needs trust, to safely put money away for your special needs child or special needs family member and they will still qualify for their government benefits. I can also assist you with
guardianship matters. Pennsylvania considers any person over the age of 18 an emancipated adult, regardless of their disabilities or needs. For this reason, I encourage families to pursue a guardianship petition for their special loved one.
All legal services I provide for special needs families are performed on a discounted basis.
Creating Effective Estate Plans
When my clients come to me to create an estate plan, I first determine their needs, goals and objectives. This is important to ensure that they have an effective estate plan and are satisfied with their protection. I understand each client has a different financial and family situation, which is why I will review your asset base and family structure (i.e. first marriage, minor children, blended family, single, etc.), before suggesting any services. I have extensive experience with guiding clients through the estate planning process and with helping them to select the most beneficial tools for their respective plan.
If you're interested in creating a will or trust, I can guide you through their pros and cons and suggest which option is most suitable to your needs. I am also proficient in advising clients on
asset protection, working with them to insulate their property. Creditors and banks may try to seize your property from you, which is why I am dedicated to finding ways to legally shield your assets through proper estate planning techniques.
I can also assist you with preparing a variety of trusts such as a revocable living trust, irrevocable life insurance trust, family dynasty trust, charitable trust, and other trust agreements suited to your specific needs. Additionally I am available to assist with settling a trust, handling the
estate taxes, and inheritance taxes and other debts that might need to be settled before the trust assets or probate assets are distributed.
I also recommend that you create a living will, to ensure your medical preferences are followed in the case of medical emergency or in case you are unable to communicate your desires to your medical care providers. This is a legal document that specifies your wishes and desires regarding life support systems and other medical considerations as well as appoints a personal representative to make these decisions for you if health prevents you from being able to specify your own wishes. You have the opportunity to choose someone that you know, love, and trust to act as your Health Care Agent.
Finally, I would recommend you have a general durable power of attorney as part of your estate planning documents. A
power of attorney is a legal document that lets you name someone you know, love, and trust to manage your financial affairs if you become physically or mentally incapacitated. Your agent under your power of attorney is authorized to perform any task in your place and in your stead and on your behalf.
Handling Probate in Moon Township and Western PA
While I often work with my clients to help them avoid probate, I understand there are some cases where that isn't possible. I have dealt with many courtroom probate processes, always aiming to minimize the costs associated with probate as well as the time my clients may have to spend in court.
If a loved one has recently died and you are named as the executor or if your loved one died without a last will and testament, you will need legal representation to prepare the petition for you which will be filed with the Orphans' Court in the county in which the decedent resided at the time of his or her death. Once you are sworn in as either the executor or the administrator of the estate, I will guide you through the probate process. You will have peace of mind knowing I have the legal expertise to handle your probate matters.
No matter what type of legal support you are looking for, I have the legal knowledge to help you navigate your affairs. Determining how to find a trustworthy and dependable attorney can be a difficult task. At my law office, my earned reputation and commitment to your satisfaction allows you to rely on my services. Whether you want to create a trust for your child's financial security or shield your assets from creditors, I am available to help. When you enlist my services, I will provide you with the support you need for your specific situation, always aiming for professionalism and efficiency.
